Terms of Service

Introduction

These Terms of Service, referred to as these Terms, govern your access to and use of the software, applications, websites, services, APIs, platforms, tools, repositories, documentation, content, hosted services, self-hosted software, developer tools, and related offerings made available by me, Om Rajguru, referred to as I, me, or my.

These offerings are collectively referred to as the Services.

The Services may include open-source software, proprietary software, hosted services, self-hosted software, downloadable software, websites, APIs, developer tools, documentation, repositories, integrations, and other current or future products or services.

By accessing, using, downloading, installing, deploying, contributing to, interacting with, or otherwise using any Service, you agree to be bound by these Terms and by any policies incorporated by reference.

If you do not agree to these Terms, you must not access or use the Services.

Scope

These Terms apply to all current and future Services that I make available, unless a specific Service is expressly governed by separate written terms, licenses, notices, or agreements.

If a Service has additional terms, those additional terms apply to that Service.

If there is a conflict between these Terms and service-specific terms, the service-specific terms control only for that specific Service.

These Terms are intended to apply broadly across open-source projects, closed-source projects, hosted services, self-hosted software, APIs, websites, documentation, and future offerings.

Incorporated Policies

The following policies are incorporated into these Terms by reference:

• Acceptable Use Policy.
• Privacy Policy.
• Security Policy.
• Code of Conduct, where applicable.
• Contributing Guidelines, where applicable.
• Project-specific licenses, notices, or terms, where applicable.

By using the Services, you agree to comply with all applicable incorporated policies.

Eligibility

By using the Services, you represent and warrant that you have the legal capacity to enter into a binding agreement.

• You represent and warrant that you are not prohibited from using the Services under applicable law.
• You represent and warrant that you will comply with all applicable laws, regulations, sanctions, court orders, legal obligations, and third-party rights.
• You represent and warrant that any information you provide is accurate, complete, and current.

If you use the Services on behalf of a company, organization, institution, government body, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.

In that case, references to you include both you and that entity.

Open-Source Software

Some Services may be released under open-source licenses.

For open-source software, your rights to use, copy, modify, merge, publish, distribute, sublicense, or otherwise deal with the software are governed by the applicable open-source license included with that software.

Nothing in these Terms limits, restricts, or overrides rights expressly granted to you under an applicable open-source license.

However, these Terms may still apply to hosted services, official websites, official APIs, accounts, documentation, trademarks, logos, branding, support channels, community spaces, integrations, paid features, and other resources connected to an open-source project.

Open-source availability does not mean that hosted services, infrastructure, branding, domains, accounts, APIs, databases, private keys, deployment systems, or proprietary components are open-source or freely reusable.

Proprietary Software and Services

Some Services, features, APIs, designs, interfaces, hosted services, documentation, content, branding, integrations, or software components may be proprietary.

Except where expressly permitted by an applicable license, written agreement, or applicable law, you must not copy, modify, distribute, sublicense, sell, lease, rent, reverse engineer, decompile, disassemble, extract, scrape, clone, or otherwise exploit any proprietary part of the Services.

All rights not expressly granted are reserved.

Hosted Services

Some Services may be operated by me as hosted services.

• You are responsible for all activity associated with your account, credentials, API keys, tokens, projects, workspaces, deployments, or other access mechanisms.
• You must keep credentials confidential and secure.
• You must promptly notify me if you believe your account, credentials, tokens, API keys, or other access mechanisms have been compromised.

I may suspend, restrict, rate-limit, disable, revoke, or terminate access to hosted Services where reasonably necessary to protect security, availability, users, infrastructure, legal compliance, policy enforcement, or the integrity of the Services.

Self-Hosted Deployments

Some Services may be capable of being self-hosted, deployed, modified, or operated independently by users or third parties.

For independently operated self-hosted deployments, the operator is solely responsible for installation, configuration, hosting, administration, security, access controls, moderation, backups, compliance, updates, maintenance, incident response, user notices, and data processing.

• I do not control independently operated deployments.
• I am not responsible for the content, data, users, security, availability, legality, compliance, operation, or misuse of independently operated deployments.

The availability of self-hosting functionality does not create any obligation for me to provide support, maintenance, hosting, monitoring, security review, updates, warranties, or assistance.

You must not represent an independently operated deployment as being operated, endorsed, certified, approved, affiliated with, or controlled by me unless I have expressly authorized it in writing.

Accounts and Access

Some Services may require an account, login, API key, access token, workspace, license key, or other access mechanism.

• You are responsible for maintaining the confidentiality and security of your account and credentials.
• You are responsible for all activity that occurs under your account, credentials, API keys, tokens, or access mechanisms.
• You must not share access credentials in a way that creates security, abuse, billing, compliance, or access-control risks.

I may revoke, rotate, suspend, or disable credentials where reasonably necessary to protect users, infrastructure, the Services, or third parties.

Acceptable Use

• You must comply with the Acceptable Use Policy and all applicable laws when using the Services.
• You must not use the Services in any manner that is unlawful, harmful, abusive, deceptive, exploitative, unsafe, unauthorized, or otherwise prohibited by the Acceptable Use Policy.

Violations may result in warning, content removal, access restriction, rate limiting, account suspension, account termination, API key revocation, blocking of traffic or integrations, refusal of support, reporting where required or permitted by applicable law, or legal action.

User Content

Some Services may allow you to submit, upload, store, transmit, process, generate, publish, or otherwise provide content, code, files, data, text, media, prompts, outputs, configuration, communications, or other materials.

• These materials are referred to as User Content.
• You retain ownership of your User Content.
• You grant me a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, reproduce, and use User Content only as reasonably necessary to operate, secure, maintain, provide, support, and improve the applicable Service, or as otherwise permitted by you.
• You represent and warrant that you have all necessary rights to your User Content.
• You represent and warrant that your User Content does not violate applicable law.
• You represent and warrant that your User Content does not infringe, misappropriate, or violate any third-party rights.
• You represent and warrant that your User Content complies with these Terms and all applicable policies.

Privacy

My handling of personal information is governed by the Privacy Policy.

• I do not sell personal information.
• I do not rent personal information.
• I do not trade personal information.
• I do not operate advertising networks.
• I do not use personal information for targeted advertising.
• I do not voluntarily provide user data to governments, law enforcement agencies, intelligence agencies, regulators, or other public authorities.

Any disclosure of user information is handled according to the Privacy Policy and applicable law.

Third-Party Services

The Services may integrate with, depend on, link to, or interoperate with third-party platforms, infrastructure, APIs, software, libraries, packages, hosting providers, authentication providers, payment providers, analytics providers, monitoring providers, email providers, security providers, or other services.

Third-party services are governed by their own terms and policies.

• I am not responsible for third-party services, third-party content, third-party infrastructure, third-party availability, third-party security, third-party conduct, or third-party data practices.

Your use of third-party services is at your own risk.

Intellectual Property

Except for rights expressly granted under an open-source license or written agreement, all rights, title, and interest in and to the Services, including software, designs, interfaces, documentation, content, names, logos, trademarks, service marks, branding, trade dress, workflows, and proprietary materials, are owned by me or my licensors.

Nothing in these Terms transfers ownership of intellectual property rights to you.

You must not use my name, logos, trademarks, service marks, branding, project names, or product names in a way that suggests endorsement, sponsorship, affiliation, approval, certification, or official status without my prior written permission.

Feedback

If you provide suggestions, ideas, bug reports, feature requests, comments, improvements, or other feedback, you grant me the right to use that feedback without restriction, attribution, or compensation.

I am not obligated to use, implement, maintain, respond to, or keep confidential any feedback unless separately agreed in writing.

Payments and Paid Services

Some Services may require payment.

Where payment is required, pricing, billing intervals, renewal terms, cancellation terms, taxes, and refund terms may be provided separately for the applicable Service.

Unless otherwise stated or required by applicable law, payments are non-refundable.

Failure to pay applicable fees may result in suspension, restriction, or termination of access to paid Services.

I may change pricing, billing models, limits, features, or paid plans from time to time, subject to applicable law and any service-specific terms.

Service Changes

I may modify, suspend, discontinue, replace, limit, restrict, or remove any Service, feature, API, integration, functionality, documentation, content, or support channel at any time.

I am not liable for any modification, suspension, discontinuation, replacement, restriction, or removal of any Service or part of a Service.

For open-source software, discontinuation of official maintenance does not affect rights already granted under the applicable open-source license.

Suspension and Termination

I may suspend, restrict, disable, revoke, or terminate your access to any Service, with or without notice, where I reasonably believe it is necessary to enforce these Terms or applicable policies.

• I may also take such action to prevent abuse, fraud, security risks, unlawful activity, infrastructure harm, policy violations, or misuse of the Services.
• I may also take such action to protect users, third parties, infrastructure, rights, property, safety, reputation, or the integrity of the Services.
• You may stop using the Services at any time.

Termination does not affect provisions that by their nature should survive, including intellectual property, privacy, disclaimers, limitation of liability, indemnification, governing law, jurisdiction, dispute resolution, and enforcement provisions.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided as is, as available, and with all faults.

• I disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, availability, security, reliability, accuracy, compatibility, and error-free operation.
• I do not warrant that the Services will be uninterrupted, secure, available, accurate, reliable, error-free, compatible with your systems, free from harmful components, or suitable for your intended purpose.

You use the Services at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, loss of revenue, loss of data, loss of business, loss of goodwill, service interruption, computer damage, system failure, security incident, or loss of opportunities.

To the maximum extent permitted by applicable law, my total liability arising out of or relating to the Services shall not exceed the greater of the amount you paid to me for the applicable Service during the twelve months before the event giving rise to the claim, or INR 10,000.

The limitations in this section apply whether the claim is based on contract, tort, negligence, strict liability, statute, warranty, or any other legal theory.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Om Rajguru from and against any claims, demands, damages, liabilities, losses, costs, expenses, and legal fees arising out of or related to your use of the Services.

This includes claims arising out of your User Content, your violation of these Terms, your violation of applicable law, your infringement or misappropriation of third-party rights, your operation of a self-hosted deployment, your misuse of hosted Services, APIs, accounts, credentials, or infrastructure, and your violation of any incorporated policy.

Force Majeure

I shall not be liable for any delay, failure, interruption, degradation, loss, or unavailability caused by events beyond my reasonable control.

Such events may include natural disasters, war, terrorism, riots, civil unrest, labor disputes, internet failures, cloud provider outages, infrastructure failures, cyberattacks, denial-of-service attacks, power failures, governmental actions, legal restrictions, supply chain failures, or other events beyond reasonable control.

Export Controls and Sanctions

You must not use, export, re-export, import, sell, transfer, or provide access to the Services in violation of applicable export control, sanctions, trade compliance, or similar laws.

You represent and warrant that you are not prohibited from using the Services under applicable sanctions, export control, or trade compliance laws.

Beta, Experimental, and Preview Services

Some Services or features may be marked or treated as beta, experimental, preview, early access, unstable, or pre-release.

Such Services may be incomplete, unreliable, changed, removed, reset, or discontinued at any time.

I do not guarantee compatibility, availability, support, data preservation, or continued operation for beta, experimental, preview, early access, unstable, or pre-release Services.

You use such Services at your own risk.

Support

Unless I separately agree in writing, I am not obligated to provide support, maintenance, updates, bug fixes, security patches, hosting assistance, consulting, migration assistance, or custom development.

I may provide support at my discretion.

Providing support in one instance does not create an obligation to provide support in the future.

Changes to These Terms

I may update these Terms from time to time.

Updated versions become effective when published unless otherwise stated.

If changes are material, I may provide notice through a relevant website, repository, Service, changelog, email, or other appropriate method.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Jurisdiction

Subject to applicable law and the nature of the dispute, any dispute, claim, proceeding, or controversy arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts and tribunals in Mumbai, Maharashtra, India.

This includes the courts exercising civil, commercial, and appropriate subject-matter jurisdiction in Mumbai, Maharashtra, India, and the High Court of Judicature at Bombay where it has jurisdiction.

Nothing in this section prevents me from seeking injunctive, equitable, or urgent relief in any court of competent jurisdiction where necessary to protect rights, security, infrastructure, users, confidential information, intellectual property, or the Services.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

The invalid, illegal, or unenforceable provision shall be interpreted or replaced to the maximum extent permitted by law to give effect to the original intent.

No Waiver

My failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Any waiver must be in writing to be effective.

Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without my prior written consent.

I may assign, transfer, or delegate my rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, change of control, business transfer, or continued operation of the Services.

Entire Agreement

These Terms, together with any policies, licenses, notices, service-specific terms, or agreements incorporated by reference, constitute the entire agreement between you and me regarding the Services.

They supersede any prior or contemporaneous agreements, communications, or understandings relating to the Services.
